Pochi and Moji — Terms of Service

These Terms of Service (the "Terms") set out the conditions on which Daiju Ishikawa ("we", "us", "our") provides the iOS app "Pochi and Moji" (Japanese name ポチッと文字; the "App"). By using the App, you (the "user") agree to these Terms.

1. What the App does

The App transcribes audio recorded on your iPhone, on the device itself; generates a document such as minutes or a report from that transcript using generative AI; and files it as a Markdown file in the folder of the Obsidian Vault you have chosen.

3.1 What credits are

Credits are the prepaid unit used to generate documents in the App.

3.2 Purchase

Credits can only be purchased through the App Store. The purchase contract is formed with Apple, and Apple receives, charges and receipts the payment.

The units available for purchase are as follows. The price that applies is the amount shown on the purchase screen in the App and on the App Store, in the currency of your country or region, inclusive of consumption tax.

3.3 Credits granted free of charge

We may grant credits free of charge, for a limited period, so that you can try the App. Credits granted free of charge can be used in the same way as purchased credits, with the following differences.

• Because no payment is made for them, they are never eligible for a refund (→ 3.12).
• We may change or end the conditions, quantity and period of such grants without prior notice.

3.4 Expiry

Credits do not expire. Purchased credits remain until they are spent.

3.5 Scope of use

Credits may be used only to generate documents in the App. They cannot be exchanged for cash or other services, transferred to another user, or refunded (except where we end document generation in the App → 3.12).

3.6 How many credits are spent

Each document costs a base of 1 credit plus an additional amount that depends on the length of the transcript, as follows.

Before you run a generation, the screen shows the maximum that it may cost. We will never charge more than the maximum shown.

The amount is calculated from the volume of text passed to the generative AI (the token count), not from the character count of the transcript. For the same content, the language spoken does not significantly change the cost.

The method of counting tokens for billing is also fixed independently of the AI model used for generation. If we change the model we use for generation, that alone will not change what you are charged.

3.7 When credits are not spent

Credits are not spent in the following cases.

• Recording and transcription (these are free and require no sign-in)
• Recordings from which no document was generated
• Sharing, exporting or re-filing a document that has already been generated
• A generation that was not run because the daily usage limit had been reached (→ 8.1)

3.8 When your balance is insufficient

Only document generation becomes unavailable. Every other function, including recording and transcription, continues to work.

3.9 Checking your unused balance

You can check it at any time on the credits screen in the App.

3.10 Return when generation fails

If a document could not be generated for reasons on our side (a fault in the generative AI or in our servers, for example), we return the credits spent on that attempt to your balance. The App shows on screen that the return has been made. If you generate again from the same recording after a return, that counts as a new generation and spends credits again.

We do not return credits in the following cases.

• The generation completed, but you have not received the result because of your own connectivity (you can receive it at no additional cost once connectivity is restored)
• The generation was not run because your balance was insufficient (no credits were spent)

3.11 Where Apple issues a refund

If Apple decides to refund a purchase, we deduct the corresponding credits from your balance. If that leaves your balance short, document generation becomes unavailable.

3.12 If we end the service

If we end document generation in the App, we will announce it in the App and on the support page ( https://da-leca.click/en/app/pochimoji/support ) at least 30 days before the closing date.

Users who still hold unused paid credits at the time of the announcement will be refunded an amount corresponding to the purchase price.

⚠️ Because we do not hold your name or email address, refunds are made on application by the user. How to apply, the period for doing so, and the information required (the order ID on your App Store receipt, for example) will be set out in the announcement.

Where the Payment Services Act or any other law requires a refund, we will follow its provisions.

⚠️ Credits granted free of charge (→ 3.3) are not eligible for a refund, because no payment was made for them.

3.13 If you delete your account

If you delete your account in the App (→ 4.4), the link between the user identifier we hold and your balance is released, and unused credits become unusable. We cannot act on requests to refund or restore a deleted balance. Before you delete, the App shows you the balance that will become unusable.

⚠️ However, Apple retains your App Store purchase history. If you purchase credits again with the same Apple ID after deletion, previously purchased credits may be restored to your balance, by virtue of how Apple and our billing provider work. This is not behaviour we control. You suffer no financial loss, but we do not guarantee that deletion will always leave your balance at zero.

4. Authentication (signing in)

4.1 When you need to sign in

You only need to sign in when you run document generation. Recording, transcription and filing to your Vault can be used without signing in.

4.2 How

Signing in uses Sign in with Apple. We do not receive your name or email address. We hold only a one-way hash of the user identifier issued by Apple, for the purpose of linking it to your credit balance.

4.3 Continuity

Your credit balance is linked to your Apple ID. If you delete and reinstall the App, or move to another iPhone using the same Apple ID, your balance carries over.

4.4 Deleting your account

You can delete your account from the settings screen in the App. Doing so releases the link between the hashed user identifier we hold and your balance, and unused credits become unusable (→ 3.13). Recordings and transcripts on your device, and documents already filed in your Vault, are not removed by deleting your account.

5. Your responsibilities

5.1 Lawfulness of recording

Whether you need the consent of the other party to record a conversation depends on the country, region and circumstances. It is your responsibility to obtain any consent required and to comply with applicable law before recording. We accept no responsibility for the lawfulness of recordings you make.

5.2 Managing your device and destinations

The App stores audio, transcripts and generated documents on your iPhone and in your iCloud Drive (Obsidian Vault). Managing your device, Apple ID and iCloud is your responsibility. We hold no backup of the data stored there.

5.3 Export to Notion

If you use the Notion export feature, you configure your own Notion integration token in the App. The token is stored only on your device and is never sent to our servers. Notion's own settings, permissions and terms are governed by your agreement with Notion Labs, Inc.

5.4 The content of transcripts

What is sent to our servers for document generation is the text of the transcript. You can view and edit the transcript before it is sent. The decision about what to send is yours.

6. About the documents generated

6.1 The nature of generative AI

Documents are created by generative AI. We instruct the model not to supply information that is absent from the transcript, but the output of generative AI can contain errors, omissions and inaccurate summaries. In particular, please check owners, deadlines, figures and proper nouns yourself before relying on them. We do not warrant the accuracy, completeness or fitness for any particular purpose of a document.

6.2 Ownership

Rights in the audio you record, its transcript, and the documents generated from it belong to you. We will not use them beyond what is necessary to provide the App (processing by the generative AI, temporary storage, and returning the result to you).

6.3 No use for training

Neither we nor the generative AI provider we use will use your audio, transcripts or generated documents to train AI models.

7. Prohibited conduct

You must not:

• use the App for any purpose contrary to law, public order or morals;
• record a person in a manner that infringes their privacy without their consent;
• analyse, modify or reverse-engineer the App, or extract the connection details embedded in it in order to reach our servers from anything other than the App;
• place an excessive load on our servers, or attempt to circumvent usage limits;
• obtain credits improperly, or use credits obtained improperly; or
• inject malicious instructions aimed at the generative AI under the guise of a transcript.

8. Usage limits

8.1 Limits

To keep the service stable and to control costs, we set a daily limit on the number of document generations (both per user and overall). Once a limit is reached, no further documents can be generated that day. Reaching a limit does not spend credits. A "day" for this purpose runs on Japan Standard Time (JST).

There is also a limit on the length of a transcript that can be sent in a single generation (200,000 characters).

We may change the specific values of these limits according to the state of the service.

8.2 Suspension

If you breach these Terms, or if we suspect misuse, we may suspend your use of document generation without prior notice.

9. Changes, interruption and termination of the service

9.1 Changes

We may change the App's functions, document types, generative AI model and the method of calculating credit consumption without prior notice. However, if we change the method of calculating credit consumption to your disadvantage, we will announce it in advance in the App.

9.2 Interruption

We may interrupt document generation temporarily because of system maintenance, faults, faults at the generative AI provider, network failures, natural disasters or other unavoidable circumstances. The App does not guarantee processing times. Generations submitted during an interruption are either processed in turn once service is restored, or treated as failures with credits returned (→ 3.10).

9.3 Termination

We may cease to provide the App. If we do, clause 3.12 applies.

10. Disclaimer and limitation of liability

1. We do not warrant that the App is fit for your particular purpose, that it has the functions, accuracy or usefulness you expect, or that it will be free from interruption or error.
2. We are not liable for loss arising from your use of, or inability to use, the App, except where caused by our intent or gross negligence.
3. Even where we are liable, our liability is limited to the total price of the credits you purchased in the App during the 12 months preceding the event giving rise to the loss. This limit does not apply where the loss is caused by our intent or gross negligence.
4. This clause does not apply to the extent that our liability cannot be limited under the Consumer Contract Act or other mandatory law.

11. Intellectual property

Intellectual property rights in the App (including its program, screens, icons, wording and the prompts used for document generation) belong to us or to the third parties that license them to us. You acquire only the right to use the App in accordance with these Terms.

12. Changes to these Terms

We may change these Terms as necessary. The revised Terms take effect when they are published in the App or on the support page ( https://da-leca.click/en/app/pochimoji/support ), or on the effective date stated in the publication. Where a change is to your disadvantage, we will announce it at least 30 days before it takes effect. If you use the App after a change, you are deemed to have agreed to the revised Terms.

13. Minors

A minor should use the App, and purchase credits, only with the consent of a parent or guardian.

14. Governing law and jurisdiction

These Terms are governed by Japanese law. In the event of a dispute between you and us concerning the App, the Tokyo District Court shall have exclusive jurisdiction in the first instance.

15. Language

These Terms are drawn up in Japanese. Translations into English, Spanish or any other language are provided for reference only; if there is any discrepancy, the Japanese version prevails.

Disclosure under the Payment Services Act of Japan

Credits in the App constitute a prepaid payment instrument for own-business use under the Payment Services Act of Japan. We issue them within a range in which the unused balance on the reference dates set by that Act (31 March and 30 September each year) does not exceed 10 million yen.

Disclosure under the Act on Specified Commercial Transactions of Japan

The purchase contract for credits is formed with Apple, and Apple receives, charges and refunds the payment. The disclosures and procedures relating to purchase are governed by the App Store terms (Apple Media Services Terms and Conditions). We do not receive your credit card or payment details.
